General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all contracts between Nicolas Loewer (hereinafter referred to as the “Provider”) and customers (B2C and B2B) for coaching services, group formats, workshops/events, and digital content booked via the website.

2. Services / No Promise of Healing

  1. The Provider offers coaching services and event facilitation.
  2. Coaching is not psychotherapy and does not replace medical or psychotherapeutic treatment. No promises of healing are made.
  3. Customers act on their own responsibility.
3. Participation Requirements
  1. Participation is permitted from the age of 18.

  2. In cases of acute psychological crisis, ongoing inpatient or psychiatric treatment, or severe instability, the offerings may not be suitable. If in doubt, please consult an appropriate professional in advance or contact me before booking.

4. Conclusion of Contract (Booking via Website)

  1. The presentation of the offerings on the website does not constitute a legally binding offer, but an invitation to book.

  2. A contract is concluded once you complete the booking process and receive a booking confirmation (or once payment confirmation is received).

5. Prices / Small Business Regulation

  1. The prices stated on the website apply.

  2. Note: Small business according to § 19 German VAT Act (UStG) — no VAT is shown, as long as this regulation applies.

6. Payment

  1. Payment is made as a one-time payment via Stripe or PayPal.

  2. Access to services or content may be dependent on successful payment.

7. Appointments, Lateness, Cancellation (1:1)

  1. Agreed 1:1 appointments are binding.

  2. Rescheduling/cancellation: Free of charge up to 48 hours before the appointment; cancellations made later or no-shows will be charged at 100%.

  3. In case of lateness, the session will be shortened accordingly; there is no entitlement to an extension.

8. Group Programs / Workshops (Online & In-Person)

  1. The schedule and content are defined in the respective offer description.

  2. To protect the integrity of the container, the Provider may establish rules (consent, confidentiality, respect, self-responsibility). A general framework is described on the Ethics/Container page (if available).

9. Recordings, Materials & Access Duration

  1. No recordings of participants will be published.

  2. If learning materials are provided (e.g. instructional videos, audio practices, handouts), they are intended for private use only. Redistribution, reproduction, or publication is prohibited.

  3. If time-limited access is provided, access is granted for 90 days from the date of availability, unless otherwise stated on the respective offer page.

10. Confidentiality

  1. The Provider treats personal content confidentially.

  2. In group formats, participants commit to not sharing content of other participants externally.

11. Right of Withdrawal (Consumers)

The statutory right of withdrawal applies to consumers in accordance with the withdrawal policy (see page /withdrawal).

Important: For leisure events tied to specific dates, there is generally no right of withdrawal (§ 312g para. 2 no. 9 German Civil Code – BGB).

12. Refund / Cancellation (Additional Goodwill Policy)

The provisions of the Refund/Cancellation page (see /refund) apply additionally. In the event of a conflict, statutory regulations and these GTC shall prevail.

13. Liability

  1. The Provider is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body, or health.

  2. In cases of slight negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations), limited to the typical, foreseeable damage.

  3. Otherwise, liability is excluded to the extent permitted by law.

14. Final Provisions

  1. German law applies. For consumers, this applies only insofar as mandatory consumer protection provisions of the country of residence are not overridden.

  2. The place of jurisdiction for merchants is Berlin.

  3. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
